Defective Product

A Defective Product is a product that contains a defect making it unsafe for use or unfit for its intended purpose. Under Australian Consumer Law, a product has a safety defect if the safety of the product is not such as persons generally are entitled to expect. Defects may arise in design, manufacture, or marketing (including warnings and instructions). The existence of a defect is typically determined by reference to the manner in which and purposes for which the product has been marketed, its packaging, instructions, and warnings.
