Failure to Warn

Failure to Warn is a category of product defect that arises when a manufacturer or supplier fails to provide adequate warnings, cautions, or instructions regarding the risks associated with a product's use or foreseeable misuse. This includes failure to warn about dangers that are not obvious to ordinary consumers. Under Australian law, the adequacy of warnings is assessed by considering what a reasonable consumer would expect to be told about the product's risks.
