Latent Defect

A Latent Defect is a hidden flaw or defect in a product that is not discoverable through reasonable inspection or testing and may not become apparent until the product has been in use for some time. Latent defects are particularly significant in products liability because they may cause injury long after the product was manufactured or sold. The discovery rule in limitation periods often allows claims for latent defects to be brought within a period after discovery rather than after manufacture.
