Legal Liability for Premises

Legal liability for premises is the legal duty an occupier or operator holds when people or property are hurt or damaged on site. Hospitality venues owe a duty of care to everyone who enters, including customers, visitors, delivery drivers, and even trespassers in some cases. Australian courts apply one general duty of care to all lawful visitors. There are no longer separate rules for different types of visitor. Courts still look at how likely harm was for each person when they decide if that duty was met.
