Product Misuse

Product Misuse refers to the use of a product in a manner that was not intended by the manufacturer and was not reasonably foreseeable. Product misuse may provide a defence to products liability claims where the injury resulted solely from the consumer's abnormal or unforeseeable use of the product. However, if the misuse was reasonably foreseeable, the manufacturer may still be liable for failing to design against such misuse or warn against it.
