Section 40(3) ICA Notification

Section 40(3) of the Insurance Contracts Act 1984 (Cth) lets policyholders notify insurers about circumstances that might lead to a claim—even before any formal demand arises. Once notified, the insurer must treat future related claims as covered, even if they happen after the policy expires. For example, if a tradie discovers a wiring defect that could later cause damage, giving notice secures future protection.
