Section 54 ICA Insurance Contracts Act

Section 54 of the Insurance Contracts Act 1984 (Cth) prevents an insurer from automatically rejecting a claim if the policyholder’s later action—such as a late notification—did not cause or worsen the loss. For example, if a tradie reports a minor claim a few days late but the delay has no impact, the insurer cannot deny it purely on timing. This provision promotes fairness between insurers and customers.
