Grievance Procedure

A grievance procedure sets out the steps an employee must follow to raise a complaint about workplace treatment, conditions, or conduct, and the obligations of the employer to respond. In Australian workplaces, grievance procedures are commonly required under enterprise agreements and are recommended under Fair Work Act 2009 (Cth) guidelines. From an insurance perspective, employment practices liability (EPL) policies typically cover costs associated with defending grievance-related claims, including unfair dismissal, discrimination, and workplace bullying allegations. Insurers assess whether an organisation has documented grievance procedures when underwriting EPL coverage, as the absence of a clear procedure may increase exposure to claims and affect both the likelihood and severity of adverse outcomes.
